“We will guarantee that any client who dives with us on one of our nine day TOFO tours will have either a Manta Ray or a Whale Shark encounter. Should we not fulfill this guarantee, the client will be refunded 500 Euro.” The guarantee of either a Manta Ray or a Whale Shark encounter shall by definition mean the following: For Manta Rays, a sighting on SCUBA, of a Manta Ray, at a distance of not less than 15 meters. If we are seeing Mantas, there are almost always more than one and they do often come within a few meters of divers . For Whale Sharks, encounters on SCUBA are generally fairly rare and we want our clients to understand that we snorkel with the Whale Sharks in Tofo. The guarantee on the Whale Shark encounter shall mean that the client will be able to get in the water and snorkel with a Whale Shark – again, when we see one Whale Shark, we usually see quite a few.

There is a weather related clause. In the event that weather conditions do not permit us to get in our full schedule of diving, the guarantee shall be void. Our standard policy is always to refund the difference of any dives not done of the twelve dive package due to weather related circumstances, and this refund will always apply. If we do get in 10 or more dives , and do not see a Manta or a Whale Shark , the guarantee will apply. If we do not do at least 10 dives during the tour, the refund does not apply. The diver ability clause requires a little more explanation. We wish to reiterate that our tour is for experienced divers only . The diving in Tofo is not difficult, but it can be moderately challenging. We are diving off of Zodiacs, the distance to some of the reefs is 14 to 18 kilometers, and we are dropping on satellite marks. Because there can often be strong surface currents, we utilize negatively buoyant entries and it is important from a safety perspective to get down to the reef as quickly as comfortably possible. Inexperienced divers, and even some “experienced” divers used to only calm and clear conditions, may experience difficulty diving in Tofo. The diving is very relaxed, fun and friendly – but diving experience is a key factor in this. Any diver who misses a drop or is unable to get down on a dive, and misses a Manta encounter that the rest of the group diving has, shall not be entitled to a refund. Unfortunately, we must also include any diver who misses a Manta encounter that the rest of the group has due to finishing the dive before the rest of the group due to any dive related condition (low on air, personal equipment failure, etc.). Also, if any diver chooses to not go on a dive, for any reason ( health, hangover, personal problems, etc.) and misses a Whale Shark or Manta encounter that the rest of the group diving has, shall also not be entitled to the refund. Also, if a client for any reason chooses to not get in the water and snorkel with a Whale Shark that the rest of the group is snorkeling with, this client shall not be entitled to the refund. 

It is very important to mention that inexperienced, careless or reckless divers have the ability to spoil the diving for the entire group and we are generally very unsympathetic towards the careless and reckless divers. It is stated clearly on our website that any diver on our tour who shows a careless or reckless disregard for safety, thereby jeopardizing their own safety or the safety of the group, shall not be allowed to dive with the group for the remainder of the tour. In such circumstances there would be no refund.Clients will be required to sign a copy of the terms and conditions at the beginning of the tour in order to be eligible for the refund.
